The issues in this effort to circumvent a non-access ("spite") easement are (1) whether Champee Springs, as a property-owners' association, has standing to sue to enforce the easement for its members to bar a road from two contiguous tracts Teal owns; (2) whether the non-access easement is unenforceable for public-policy reasons; and (3) whether the easement is invalid in part because inconsistent conduct estops enforcement.
